1. Acceptance of Terms
By subscribing to or purchasing from the Service, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you may not access or use the Service. Red Fools Studio LLC (“we,” “us,” or “our”), located at 10268 W. 52nd Place, Wheat Ridge, CO 80033, reserves the right to update or modify these Terms at any time without prior notice. Your continued use of the Service constitutes acceptance of any updated Terms.
2. Description of Service
The Service provides access to Red Fools Studio LLC’s premium learning materials, including but not limited to courses, videos, tutorials, and other educational content (“Content”). This Content may be accessed via:
An Annual Subscription: Providing complete access to the library for a recurring fee of $149.99 per year plus applicable taxes, billed until cancellation.
Individual Course Purchases: Providing standalone access to specific, individual courses purchased on a one-off basis.
3. Free Trial
If a free trial is offered for the annual subscription, you will not be charged the subscription fee until the free trial period ends. The duration of the free trial will be specified at the time of sign-up. Upon completion of the free trial, your subscription will automatically renew at the standard rate of $149.99 per year plus applicable taxes unless canceled before the trial period ends. You may cancel your subscription at any time during the free trial without incurring charges.
4. Subscription and Payment
Automatic Renewal: Your annual subscription will automatically renew each year unless you cancel it in accordance with Section 6. Payment Authorization: By subscribing or purchasing Content, you authorize Red Fools Studio LLC to charge your payment method for the specified fees and any applicable taxes. You are responsible for ensuring that your payment information is accurate and up-to-date. No Refunds: All payments for the Service (including individual course purchases and recurring subscription fees) are non-refundable, including for any unused portion of a subscription or during a free trial period, except as required by applicable law.
5. Email Communications & Marketing
By subscribing to the Service, purchasing an individual course, creating an account, or submitting your email through any signup form on our site, you expressly agree to receive transactional notifications, updates, and promotional or marketing emails from Red Fools Studio LLC. You understand that you are allowing us to send you these communications for promotional purposes but that you can opt out at any time. You may cancel or manage your email subscription by clicking the "unsubscribe" link found at the footer of any marketing email we send you.
6. Cancellation by Subscriber
You may cancel an annual subscription at any time through your account settings or by contacting our customer support team at Redfoolscontact@gmail.com. Cancellation will take effect at the end of the current billing cycle, and you will retain access to the subscription Content until that time.
7. Termination and Access Revocation by Red Fools Studio LLC
Red Fools Studio LLC reserves the right to suspend, restrict, or permanently terminate your access to the Service—including access to both active subscriptions and previously purchased individual courses—at any time, with or without notice, at our sole discretion. This includes, but is not limited to, situations where we deem it necessary to protect the security of the site, our intellectual property, or the safety and well-being of other community members. Upon termination, you will no longer have access to any Content, and no refunds or credits will be provided.
8. No Refunds
All subscription fees and individual course purchase fees are completely non-refundable, whether access is canceled by you or terminated/revoked by Red Fools Studio LLC, except as required by applicable law.
9. Collection and Protection of Personal Data
To process payments and provide the Service, Red Fools Studio LLC will collect personal information, including but not limited to your name, address, email, and credit card or other payment information. We take reasonable measures to protect your personal data; however, in the event of a data breach, we will use our best efforts to promptly notify affected individuals in accordance with applicable laws. 10. Use of Service & Course Access
Eligibility: You must be at least 18 years old or have the consent of a parent or guardian to use the Service.
License: Red Fools Studio LLC grants you a limited, non-exclusive, non-transferable, revocable license to access and view the Content you have actively subscribed to or individually purchased for personal, non-commercial purposes.
No Lifetime Access Guarantee: Buying an individual course grants you access to that specific content, but does not constitute a guarantee of permanent or lifetime access. Access remains subject to the site's ongoing operations and our right to restrict or revoke access under Section 7. Prohibited Uses: You may not copy, reproduce, distribute, modify, create derivative works from, or share any Content with others without express written permission from Red Fools Studio LLC. Unauthorized sharing or commercial use will result in immediate termination of all account access without a refund.
11. Intellectual Property
All Content provided through the Service is owned by Red Fools Studio LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You agree not to infringe upon these rights or use the Content in any manner not expressly permitted by these Terms.
12. Limitation of Liability
To the fullest extent permitted by law, Red Fools Studio LLC, its affiliates, and their respective officers, directors, employees, or agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to loss of data, profits, or business opportunities. Our total liability for any claim related to the Service will not exceed the total amount you paid to Red Fools Studio LLC during the 12 months immediately preceding the claim.
13. Disclaimer of Warranties
The Service and Content are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Red Fools Studio LLC does not guarantee that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Colorado.
